1. General Provisions
1.1. These Terms and Conditions (hereinafter referred to as “T&C“) of the company L’EAU DE SPA s.r.o., ID No.: 24501786, VAT No.: CZ24501786, with its registered office at Chebská 355/49, 360 06 Karlovy Vary, Czech Republic, registered in the Commercial Register maintained by the Regional Court in Plzeň, Section C, Insert 48074 (hereinafter referred to as the “Seller” or “we“) govern the mutual rights and obligations of the contracting parties arising in connection with the conclusion of a purchase contract (hereinafter referred to as the “Contract“) between the Seller and the buyer (hereinafter referred to as the “Buyer“) through the Seller’s online store available at www.leaudespa.com (hereinafter referred to as the “e-shop“).
1.2. These T&C are an integral part of every concluded Contract. By submitting an order, the Buyer confirms that they have read these T&C, agree with them, and accept them without reservation.
1.3. The Seller reserves the right to change or supplement these T&C at any time. The rights and obligations of the parties are governed by the version of the T&C effective at the time the Contract is concluded.
2. Subject of the Contract and Purchase Price
2.1. The subject of the Contract is the sale of perfumes and related cosmetics of the L’EAU DE SPA brand.
2.2. All prices listed on the e-shop are final and include Value Added Tax (VAT).
2.3. Shipping Costs:
3. Order and Conclusion of the Purchase Contract
3.1. All goods presented on the e-shop are for informational purposes only, and the Seller is not obliged to conclude a purchase contract regarding these goods. The provision of Section 1732(2) of the Czech Civil Code shall not apply.
3.2. The Contract is concluded at the moment the Buyer receives a confirmation of the order acceptance at the e-mail address provided by the Buyer.
4. Payment Terms
4.1. The Seller exclusively accepts online card payments (including Apple Pay and Google Pay) through the secure Stripe payment gateway. Payment by bank transfer is not available on this e-shop.
4.2. Goods are dispatched only after the online payment has been successfully completed and verified in the system.
5. Shipping and Delivery Terms
5.1. The Seller uses reputable carriers (e.g., DPD, Czech Post, DHL, FedEx) for delivery. The selection of the specific carrier is at the discretion of the Seller.
5.2. Delivery Times:
5.3. Upon receipt, the Buyer is obliged to check the integrity of the packaging. In case of damage, it is necessary to write a damage report with the carrier or refuse to accept the shipment.
6. Withdrawal from the Contract
6.1. A Buyer who is a consumer has the right to withdraw from the Contract without giving a reason within 14 days of receiving the goods.
6.2. Notice of withdrawal must be sent as an unequivocal statement to the e-mail address: [email protected].
6.3. The goods must be sent back to the address: L’EAU DE SPA s.r.o., Chebská 355/49, 360 06 Karlovy Vary, Czech Republic. The costs associated with returning the goods are borne by the Buyer.
6.4. Important Notice – Hygiene: Pursuant to Section 1837(g) of the Czech Civil Code, it is not possible to withdraw from a contract for the supply of goods in sealed packaging which the consumer has unsealed and which cannot be returned for hygienic reasons. Therefore, for unsealed or used perfumes and cosmetics, the right of withdrawal expires.
7. Complaints and Warranty
7.1. The Seller is liable for defects for a period of 24 months. The Buyer shall file a complaint via e-mail at [email protected]. Goods for complaint shall be sent to the address: L’EAU DE SPA s.r.o., Chebská 355/49, 360 06 Karlovy Vary, Czech Republic.
7.2. Notice regarding purchases from partners: Complaints regarding goods purchased at partner boutiques must be filed directly with the respective seller. A list of our official points of sale can be found here: leaudespa.com/boutiques.
7.3. Complaints will be settled without undue delay, no later than 30 days from the date the complaint was filed.
8. Final Provisions
8.1. These T&C and the Contract are governed by the laws of the Czech Republic. Any disputes will be resolved before the competent courts of the Czech Republic. The consumer also has the right to an out-of-court settlement of a dispute with the Czech Trade Inspection Authority (www.coi.cz).
8.2. These Terms and Conditions are effective as of May 7, 2026.
1. Úvodní ustanovení
1.1. Tyto obchodní podmínky (dále jen „OP“) společnosti L’EAU DE SPA s.r.o., IČ: 24501786, DIČ: CZ24501786, se sídlem Chebská 355/49, 360 06 Karlovy Vary, zapsané u Krajského soudu v Plzni, oddíl C, vložka 48074 (dále jen „Prodávající“ nebo „my“) upravují vzájemná práva a povinnosti smluvních stran vzniklé v souvislosti s uzavřením kupní smlouvy (dále jen „Smlouva“) mezi Prodávajícím a kupujícím (dále jen „Kupující“) prostřednictvím internetového obchodu Prodávajícího dostupného na adrese www.leaudespa.com (dále jen „e-shop“).
1.2. Tyto OP jsou nedílnou součástí každé uzavřené Smlouvy. Odesláním objednávky Kupující potvrzuje, že se s těmito OP seznámil, souhlasí s nimi a bez výhrad je přijímá.
1.3. Prodávající si vyhrazuje právo tyto OP kdykoli měnit či doplňovat. Práva a povinnosti smluvních stran se řídí zněním OP platným v době uzavření Smlouvy.
2. Předmět smlouvy a kupní cena
2.1. Předmětem Smlouvy je prodej parfémů a související kosmetiky značky L’EAU DE SPA.
2.2. Všechny ceny uvedené na e-shopu jsou konečné a zahrnují daň z přidané hodnoty (DPH).
2.3. Náklady na dopravu:
3. Objednávka a uzavření kupní smlouvy
3.1. Veškeré zboží prezentované na e-shopu je informativního charakteru a Prodávající není povinen uzavřít kupní smlouvu ohledně tohoto zboží. Ustanovení § 1732 odst. 2 občanského zákoníku se nepoužije.
3.2. Smlouva je uzavřena v okamžiku, kdy je Kupujícímu doručeno potvrzení o přijetí objednávky na jím uvedenou e-mailovou adresu.
4. Platební podmínky
4.1. Prodávající akceptuje výhradně online platby kartou (včetně Apple Pay a Google Pay) prostřednictvím zabezpečené platební brány Stripe. Platba bankovním převodem není na tomto e-shopu umožněna.
4.2. Zboží je expedováno až po úspěšném provedení online platby a její verifikaci v systému.
5. Doprava a dodací podmínky
5.1. Prodávající využívá pro doručení renomované dopravce (např. DPD, Česká pošta, DHL, FedEx). Výběr konkrétního dopravce je v kompetenci Prodávajícího.
5.2. Dodací lhůty:
5.3. Kupující je povinen při převzetí zkontrolovat neporušenost obalu. V případě poškození je nutné sepsat s dopravcem protokol nebo převzetí zásilky odmítnout.
6. Odstoupení od smlouvy
6.1. Kupující (spotřebitel) má právo odstoupit od Smlouvy bez udání důvodu do 14 dnů od převzetí zboží.
6.2. Odstoupení musí být zasláno formou jednoznačného prohlášení na e-mail: [email protected].
6.3. Zboží musí být zasláno zpět na adresu: L’EAU DE SPA s.r.o., Chebská 355/49, 360 06 Karlovy Vary. Náklady na vrácení zboží nese Kupující.
6.4. Důležité upozornění – Hygiena: Dle § 1837 písm. g) občanského zákoníku nelze odstoupit od smlouvy u zboží v uzavřeném obalu, které spotřebitel z obalu vyňal a které není možné vrátit z hygienických důvodů. U rozbalených nebo použitých parfémů tedy právo na odstoupení zaniká.
7. Reklamační řád
7.1. Prodávající odpovídá za vady po dobu 24 měsíců. Reklamaci uplatňuje Kupující e-mailem na [email protected]. Reklamované zboží se zasílá na adresu: L’EAU DE SPA s.r.o., Chebská 355/49, 360 06 Karlovy Vary.
7.2. Upozornění pro nákup u partnerů: Reklamace zboží zakoupeného v partnerských buticích musí být uplatněna přímo u daného prodejce. Seznam našich oficiálních prodejních míst naleznete zde: leaudespa.com/boutiques.
7.3. Reklamace bude vyřízena nejpozději do 30 dnů.
8. Závěrečná ustanovení
8.1. Tyto OP a Smlouva se řídí právním řádem České republiky. Případné spory budou řešeny před příslušnými soudy ČR. Spotřebitel má právo na mimosoudní řešení sporu u České obchodní inspekce (www.coi.cz).
8.2. Tyto obchodní podmínky jsou účinné od 7. května 2026.
